- Минимальная продолжительность аренды – 1 сутки (24 часа) с момента получения автомобиля.
- Мы выдадим и примем у Вас автомобиль в любое время и по любому адресу по предварительной договоренности. Стоимость доставки/возврата в черте города от 1000 руб.
- Когда мы отдаем Вам автомобиль он чистый и с полным баком. Просим вернуть его также чистым и заправленным. Если автомобиль возвращается грязным и/или не заправленным, Вам нужно будет оплатить компенсацию из расчета: от 1200 руб. за мойку в зависимости от автомобиля и степени загрязнения, и заправку из расчета 65 руб/литр топлива;
- На прокатном автомобиле запрещено выезжать за пределы Российской Федерации. Если Вам нужно выехать из города / области – предупредите нас об этом при оформлении договора.
- Если за руль арендованного ТС сядет дополнительный водитель, он должен быть записан в договор. Требования по возрасту, стажу, необходимым документам сохраняются.
- Ограничение пробега для автомобиля - 400 км в сутки.
Считаем суммарно за весь период аренды. При превышении лимита – оплата от 7 рублей за каждый километр свыше. - Арендодатель может отказать в выдаче автомобиля без объяснения причины, о чем уведомляет клиента не менее чем за 2 часа до предполагаемой выдачи.
- Курить в автомобиле запрещено!
- При ДТП и любом причинении ущерба автомобилю первым делом известите нас, мы расскажем, как действовать в сложившейся ситуации. Если ДТП произошло не по Вашей вине, и предоставлены все справки с места ДТП – сумма ответственности равна нулю.
- За повреждение шин - полная материальная ответственность.

1. Использование автомобиля не должно противоречить его назначению, техническим характеристикам, правилам страхования автомобиля и положениям настоящего Договора.
2. Передаваемое в аренду Транспортное средство принадлежит Арендодателю на законном основании.
3. Арендатор вправе вернуть автомобиль раньше срока, предусмотренного настоящим Договором, при этом происходит перерасчет арендных платежей кратного 1 суткам. Арендодатель возвращает Арендатору соответствующую часть полученной арендной платы, исчисляя ее со дня следующего за днем фактического возврата автомобиля.
4. В случае несвоевременной передачи транспортного средства по истечении срока аренды, в случае причинения Арендодателю убытков, признания страховой компанией случая, участником которого стал Арендатор, не страховым, а так же в случае нарушения Арендатором своих обязательств по настоящему Договору, Арендодатель имеет право возместить убытки за счет суммы залога, в безусловном порядке. Оставшуюся сумму залога Арендодатель возвращает Арендатору.
5. В случае недостаточности суммы залога для погашения убытков, Арендодатель вправе взыскать недостающую сумму с Арендатора в порядке, предусмотренном действующим законодательством.
6. В случае нарушения Арендатором любого из положений договора Арендодатель вправе в одностороннем порядке без какого-либо предварительного уведомления расторгнуть настоящий договор с возможным последующим изъятием автомобиля независимо от его местонахождения. В этом случае Арендодатель не несет ответственность за пропажу или ущерб, причиненный вещам или материалам, находившимся в автомобиле в момент изъятия. Остаток арендной платы и суммы залога в этом случае возврату не подлежат.
7. Стороны договора согласны с тем, что в соответствии с действующим законодательством к договору аренды транспортного средства без водителя, не применяются положения и правила о возобновлении договора аренды на неопределенный срок и о преимущественном праве Арендатора на заключение договора аренды на новый срок.
8. Истечение срока действия настоящего Договора влечет за собой прекращение обязательств сторон по нему, но не освобождает от ответственности за его нарушения, если таковые имели место при исполнении условий договора в течение срока аренды.
9. Права и обязанности Арендодателя
9.1. Арендодатель предоставляет автомобиль в исправном состоянии, в чистом виде, с полным баком бензина. Передача осуществляется по акту приёма-передачи, который составлен Арендодателем и подписывается Сторонами (Приложение № 2 к настоящему договору).
9.2. Арендодатель, как собственник автомобиля, несет расходы по страхованию автомобиля, в порядке, установленном действующим законодательством (ОСАГО).
9.3. Арендодатель вправе требовать от Арендатора уплаты арендных платежей в установленный срок.
9.4. Арендодатель вправе потребовать расторжения настоящего договора, в случае, если Арендатор пользуется имуществом ненадлежащим образом (не в соответствии с назначением транспортного средства и с нарушением условий настоящего договора).
9.5. Арендодатель вправе отказаться от приемки транспортного средства по окончании срока действия настоящего договора в случае не исполнения Арендатором п.п. 11.1, 11.2, 11.3, 11.9, 11.10, 11.11, 11.12 настоящего договора, если техническое состояние транспортного средства не пригодно для дальнейшей эксплуатации. Арендатор в данном случае обязан возместить причиненные Арендодателю убытки путем компенсации стоимости транспортного средства или передачи аналогичного транспортного средства в собственность Арендодателя.
9.6. В случае просрочки возврата транспортного средства после окончания срока действия аренды более 2 часов Арендодатель вправе обратиться в правоохранительные органы с заявлением о возбуждении уголовного дела по факту хищения или угона 9.7.Арендодатель имеет право зачесть в счет причитающихся ему платежей и штрафов по настоящему Договору сумму залога в безусловном порядке.
9.7. При не соблюдении Арендатором п. 10.8. настоящего договора Арендодатель оставляет за собой право не принимать автомобиль и не возвращать залог до устранения недостатков.
9.8. В случае грубого нарушения условий настоящего Договора, Арендодатель имеет право расторгнуть договор в одностороннем порядке, без какого-либо предварительно уведомления Арендатора, с немедленным изъятием автомобиля из пользования Арендатора, при этом перерасчет арендных платежей не производится, вне зависимости от срока использования автомобилем.
9.10. Арендодатель предоставляет автомобиль Арендатору, с правом наблюдения за его передвижением через спутниковую систему GPS/ГЛОНАСС.
10. Права и обязанности Арендатора
10.1. Арендатор своими силами осуществляет управление арендованным Автомобилем и самостоятельно производит его эксплуатацию.
10.2. Арендатор не вправе производить разборку и ремонт автомобиля, а так же не вправе производить вмешательство в конструкцию автомобиля и устанавливать на него дополнительное оборудование без предварительно письменного согласия Арендодателя.
10.3. Арендатор не имеет право переуступать свои права и обязанности по настоящему договору третьим лицам, а также не вправе сдавать имущество в субаренду, заключать с третьими лицами договоры перевозки, в ходе которых используется автомобиль, закладывать имущество, сдавать его в поднаем, иначе предоставлять права распоряжения имуществом третьим лицам. Кроме того, Арендатор обязуется не использовать автомобиль для буксировки любых транспортных средств, для езды с прицепом или по бездорожью, для участия в спортивных соревнованиях (ралли, гонки и т.п.) а также обучению вождения.
10.4. Арендатор обязан соблюдать скоростной режим установленный Правилами дорожного движения при передвижении в городской черте и за пределами городской черты.
10.5. Арендатор несет все расходы, связанные с эксплуатацией автомобиля, не отнесенные к обязанностям арендодателя (в том числе по бензину).
10.6. Арендатор обязуется по истечении срока действия Договора возвратить Арендодателю предоставленный автомобиль в полной комплектации, в надлежащем техническом состоянии, с учетом нормального износа (в состоянии пригодном для эксплуатации без ухудшения его потребительских качеств и внешнего вида), с полным баком бензина согласно Приложению № 1.
10.7. Автомобиль должен быть возвращен в чистом виде, то есть после полной мойки автомобиля (кузов, салон). Арендатор имеет право мыть автомобиль только на специализированных предприятиях.
10.8. В случае не выполнения п. 10.7. настоящего договора, мойка автомобиля осуществляется силами сотрудников автопроката с последующим подписанием акта приёма-передачи. Стоимость данной услуги вычитается из суммы залога арендатора в безусловном порядке согласно прейскуранта о дополнительных услугах.
10.9. Исправность, комплектация, принадлежности и другие данные сдаваемого в аренду автомобиля должны быть проверены Арендодателем в присутствии Арендатора и отмечены в акте приёма-передачи.
10.10. В случае возникновения неисправностей транспортного средства вследствие нарушения Арендатором правил технической эксплуатации как во время аренды, так и обнаруженных в ходе сдачи-приемки транспортного средства после окончания срока аренды, Арендатор обязан возместить Арендодателю стоимость транспортировки, ремонта (согласно калькуляции), а также убытки, вызванные простоем транспортного средства, связанным с ремонтом.
11. Арендатор обязуется:
11.1. Рекомендуем хранить транспортное средство в случае его не использования на охраняемых автостоянках. В случае оставления транспортного средства без присмотра Арендатор несет ответственность за вред, причиненный транспортному средству. Данное обстоятельство распространяется на случаи хищения и угона.
11.2. Постоянно хранить при себе документы на автомобиль.
11.3. Нести ответственность за вред (ущерб), причиненный арендованным транспортным средством, его механизмами, устройствами и оборудованием третьим лицам или Арендодателю.
11.4. Производить регулярную тщательную проверку автомобиля на наличие внешних и внутренних неисправностей, а при их обнаружении незамедлительно ставить в известность Арендодателя.
11.5. По первому требованию Арендодателя предоставить автомобиль для прохождения технического осмотра.
11.6. Своевременно производить оплату аренды автомобиля.
11.7. Бережно относиться к вверенному ему имуществу.
11.8. Незамедлительно сообщать Арендодателю обо всех технических неисправностях, обнаруженных во время использования автомобиля. При этом в случае обнаружения неисправностей, делающих невозможным либо опасным управление автомобилем, немедленно прекратить его эксплуатацию.
11.9. Арендатор обязуется оказать всевозможное содействие Арендодателю в урегулирование страхового спора, а так же в получении страхового возмещения при возникновении страхового случая.
11.10. В бесспорном порядке компенсировать Арендодателю ущерб, нанесенный Арендатором, по первому требованию Арендодателя.
11.11. При возникновении ДТП Арендатор обязан неукоснительно выполнять все требования, предусмотренные для подобных случаев действующим законодательством, в том числе Правилами дорожного движения РФ, а также законодательством об ОСАГО. Помимо установленных требований Арендатор обязан:
- Незамедлительно (не позднее 24 часов) известить Арендодателя о ДТП и действовать в соответствии с его указаниями;
- При наличии технической возможности произвести фото-видеосъемку места ДТП и передать запись Арендодателю;
- По факту разбирательства по обстоятельствам ДТП получить от компетентных органов (полиция, прокуратура, суд и т.д.) составленные ими процессуальные документы по факту ДТП (справки, протоколы, постановления и.т.д.), а также являться по вызову в указанные органы в назначенное время;
- В течение 3 (трёх) дней после получения всех документов от компетентных органов, предоставить их Арендодателю;
- Если в результате ДТП транспортное средство получило повреждения, исключающие его дальнейшую эксплуатацию, Арендатор обязуется доставить аварийное транспортное средство за свой счет в место, указанное Арендодателем.
11.12. В случае обнаружения повреждений транспортного средства, вызванных стихийным бедствием или противоправными действиями третьих лиц, в том числе падение снега, льда с крыш жилых домов зданий, сооружений, падение иных предметов, Арендатор обязуется:
- Немедленно обратиться в ближайшее отделение полиции с заявлением о происшествии;
- Незамедлительно (не позднее 24 часов) проинформировать Арендодателя и действовать в соответствии с его указаниями;
- В течение 2 (двух) дней предоставить Арендодателю талон-уведомление о принятии заявления органами МВД, а также в этот же срок предоставить Арендодателю заверенные копии постановления о возбуждении уголовного дела либо об отказе в возбуждении уголовного дела из компетентных органов после их получения.
11.13. В случае утраты транспортного средства при любых обстоятельствах Арендатор обязуется:
- Немедленно обратиться в ближайший отдел полиции с заявлением о происшествии;
- Незамедлительно (не позднее 24 часов) проинформировать Арендодателя и действовать в соответствии с его указаниями;
- В течение 3 (трех) дней передать Арендодателю свидетельство о регистрации транспортного средства, страховой полис ОСАГО и ключи от транспортного средства.
11.14. Арендатор даёт свое согласие на предоставление и обработку персональных данных Арендодателю, включая любые действия, предусмотренные Федеральным законом от 27.07.2006 года № 152-ФЗ « О персональных данных.
11.15. Арендатор несет ответственность за сохранность арендуемого автомобиля в течение всего срока аренды до момента передачи его Арендодателю. В случае утраты или повреждения автомобиля Арендатор обязан возместить Арендодателю все причиненные убытки, в том числе упущенную выгоду, вызванную простоем автомобиля.
11.16. В случае нарушения скоростного режима установленного п. 4.2.5. настоящего Договора (согласно данным GPS/ГЛОНАСС навигации) Арендодателем из залога удерживаются штрафы.
11.17. При грубом и неоднократном нарушении Арендатором скоростного режима (согласно данным GPS/ГЛОНАСС навигации) установленного п. 4.2.5. настоящего Договора, Арендодатель имеет право изъять транспортное средство без возврата Арендатору ранее уплаченных денежных средств за арендуемое транспортное средство и залога. В случае если Арендодателем не было изъято транспортное средство, то Арендатор уплачивает штраф в размере стоимости залога.
11.18. В случае помещения транспортного средства на штрафную стоянку ГИБДД по вине Арендатора, на последнего возлагается обязанность по оплате соответствующей стоянки, с оплатой и необходимых штрафных санкций. В данном случае арендная плата за пользование автомобилем перерасчету, в соответствии с п. 2.4. настоящего договора, не производится.
12. Арендатор несет полную материальную ответственность если автомобиль угнан с ключами и документами.
13. Арендатор несет риск утраты товарной стоимости арендованного автомобиля, в случае его виновности в Дорожно-транспортном происшествии.
14. В случае причинения Арендатором вреда третьим лицам при использовании автомобиля, что повлекло обязанность страховой компании выплатить страховое возмещение потерпевшему (потерпевшим), Арендатор обязан возместить Арендодателю расходы, связанные с регрессными требованиями страховой компании.
15. Арендодатель не несет ответственности за совершенные Арендатором административные правонарушения. В случае, если Арендодателю направляется требование об уплате штрафов за совершенные Арендатором правонарушения, Арендодатель пересылает данное требование Арендатору, который обязан в течение трех дней с момента получения соответствующего требования его удовлетворить. При этом требование об уплате штрафа направляется по почтовому адресу Арендатора, указанному им при подписании настоящего Договора.
16. С момента получения автомобиля в пользование и до сдачи его Арендодателю, Арендатор является владельцем арендованного транспортного средства и в соответствии с действующим законодательством Российской Федерации несет ответственность за вред, причиненный жизни, здоровью и имуществу третьих лиц в результате эксплуатации автомобиля в той части, в какой расходы по гражданской ответственности превысят суммы страховых выплат.
17. Арендатор самостоятельно и за свой счет в полном объеме несет расходы, связанные с вредом, причиненным его жизни и здоровью, а также жизни и здоровью пассажиров, находившихся в автомобиле в период его эксплуатации Арендатором.
18. Арендатор самостоятельно и за свой счет в полном объеме несет ответственность за ущерб, причиненный багажу, принадлежащему ему или пассажирам на любом законном основании, и находившемуся в автомобиле в период его эксплуатации Арендатором

\n\n2. Rented car is a legal propriety of Owner.
\n\n3. Renter can return vehicle ahead of schedule, termed by this Agreement. In this case owner recalculates rental payment divisible 1 day. Owner refund Renter the corresponding part of rental payment, calculated from day after the day of returning the car. (will be refunded for unused days, day of returning - is using day).

In the case of a delayed transfer of the vehicle upon the expiration of the rent term, in the case of losses to the Owner, in the case of the non-insurance accident occurred in rent period, and in case the Renter breaches hiss obligations under this Agreement, the Owner has the right to compensate for the losses the amount of bail unconditionally. The remaining amount of the deposit the Owner returns to the Renter.
\n\n5. If the deposit was not enough to compensate losses, Owner has right to make Renter compensate losses in a manner provided by the law.
\n\n6. If Renter breaches any term of this agreement, Owner has right to unilaterally terminate the agreement without previous notice with possible subsequent recovering of the rented vehicle, regardless of its location. In case of vehicle recovering, Owner is not responsible for loss or damage to things left in vehicle. Renter will not get deposit back or refund for unused days.
\n\n7. Both parties agree that according to existing laws of vehicle without driver rental agreement, there are no terms and rules about renewing agreement for unlimited period and there are no exclusive right of Renter in case of making a new agreement for a new period.
\n\n8. Ending of rental period of this agreement ends parties obligations, but don’t relieve from the responsibility of violations, if there were any during rental period.
\n\n9. Rights and obligations of Owner
\n\n9.1. Owner provides vehicle in good working order and condition, safe and clean condition, with full fuel tank. The picking up of the vehicle procedure is done by delivery-acceptance act (acceptance report), which is drafted by Owner and signed by Parties (Appendix No.2 to this agreement).
\n\n9.2. Owner, as vehicle owner, pays for vehicle insurance in a manner provided by existing laws (OSAGO).
\n\n9.3. Owner has right to require from Renter rental payment within the prescribed time.
\n\n9.4. Owner has right to request agreement termination in case if Renter uses vehicle not in a right way (not in its purpose and with breaching of the terms of these agreement).
\n\n9.5. Owner has right to refuse acceptance of the vehicle after expiration of rental agreement in case if Renter breached clause 11.1, 11.2, 11.3, 11.9, 11.10, 11.11, 11.12 of this agreement, if technical condition of vehicle is no longer suitable for further use. Renter shall fully indemnify the Owner by compensating full cost of vehicle or transfer the ownership of analogous vehicle to Owner.
\n\n9.6. If Renter do not return vehicle more than 2 hours after expiration of rental agreement, Owner has right to request law enforcement authorities to have opened criminal proceedings against Renter on suspicion of stolen vehicle.
\n\n9.7. If Renter breaches clause 10.9 of this agreement, Owner has right to not accept the vehicle and not refund the deposit until all defects are corrected.
\n\n9.8. In case of breaching the terms of this Agreement, Owner has right to unilaterally terminate it without previous notice for Renter, with immediate recovery of rental vehicle. There are no recalculations of rental payments, regardless of period of actual usage of the rented vehicle.
\n\n9.10. Owner provides vehicle to Renter with right to monitor its movement through satellite system GPS/GLONASS.
\n\n10. Rights and obligations of Renter
\n\n10.1. Renter operates and drives the Vehicle by himself.
\n\n10.2. Renter has no right to salvage and repair the vehicle, do modifications to it and install accessories on it without previous written agreement from Owner.
\n\n10.3. Renter has no right to assign rights and obligations under this Agreement to any third party, to sublet or hire the vehicle to any third party, to pledge the vehicle, to sublet the vehicle to any third party in any other ways. Moreover, Renter shall not use the vehicle to push or tow another vehicle, to drive it with trailer or offroad, use the vehicle in any race, competition (rally, race and so on) or driving practice.
\n\n10.4. Renter must follow the speed limits stated by traffic laws inside and outside of the city.
\n\n10.5. Renter pays all use of the vehicle expenses, which are not in Owner’s obligations (including fuel).
\n\n10.6. Renter shall return the vehicle in complete set, in a proper technical condition, with allowance for normal wear (in a good using condition with no degradation of its consumer appeal and exterior), with full fuel tank according to Appendix No.1.
\n\n10.7. Vehicle must be returned clean. It means full service wash (exterior and interior). Renter shall wash vehicle only on specialized car washes.
\n\n10.8. In case of breaching the clause 10.7 of this agreement, Vehicle will be washed by employees of car rental company with subsequent signing of delivery-acceptance act. According to price list of additional services the cost for this service will be subtracted from deposit.
\n\n10.9. Condition, vehicle configuration, accessories and other information about returned vehicle must be checked by Owner in presence of Renter and marked in delivery-acceptance act.
\n\n10.10. In case of failure occurrence due to Renter’s use of vehicle during this agreement, or failure detected during delivery-acceptance procedure at the end of the rental period, Renter shall fully indemnify the Owner for transportation, repairing (according to calculation) and losses for idle (repair) time of vehicle.
\n\n11. Renter agrees to:
\n\n11.1. Keep vehicle, in case of not using it, only on secured car parkings, which has all necessary documents to do such service, which can be approved by pay checks. In case of leaving the vehicle unattended, Renter takes responsibility for any loss or damage to the vehicle or Owner. This circumstance distributes on all cases of stolen vehicle.
\n\n11.2. Constantly keep vehicle documents with himself.
\n\n11.3. Be responsible for loss or damage that is done by rented vehicle, its parts or accessories to third party or Owner.
\n\n11.4. Regularly check vehicle for interior or exterior failures. If something detected, immediately inform Owner.
\n\n11.5. On first demand provide the vehicle to Owner for doing technical inspection.
\n\n11.6. Pay rental for vehicle in a timely manner.
\n\n11.7. To take good care of the rented property.
\n\n11.8. Immediately inform the Owner about all technical failures, detected during the use of the vehicle. If using the vehicle with detected failures is dangerous or impossible, immediately stop using the vehicle.
\n\n11.9. Renter shall do all sorts of assist to Owner in settlement of insurance dispute and in receiving insurance benefit.
\n\n11.10. On first demand, Renter shall, without any dispute, compensate to Owner losses, which are done by Renter.
\n\n11.11. In case of a car accident, Renter shall strictly fulfill all the requirements, that are stated for such cases in existing laws, including traffic laws and OSAGO laws. In addition to stated requirements, Renter shall:- Immediately (not more than 24 hours) inform Owner about accident and follow instructions from Owner;- If there is technical feasibility, make photo and video of car accident and provide it to Owner;- After all proceedings related to car accident, receive process documents (references, protocols, statements) composed by relevant authorities (police, prosecutor’s office, court, etc.), and be at mentioned authorities at specified time;- During 3 (three) days after receiving all documents from relevant authorities, provide them to Owner;- If in a result of car accident vehicle is no longer suitable for further use, Renter shall deliver wrecked vehicle on Renter’s expense to place of receipt, specified by Owner.
\n\n11.12. In case of detecting damages to vehicle, caused by natural disaster or third party criminal acts, including falling snow, ice from the roofs of the houses or other buildings, or falling of other objects, Renter shall:- Immediately make an application about situation to the nearest police station;- Immediately (not more than 24 hours) inform and follow instructions from Owner;- During 2 (two) days provide to Owner advice note of accepting the application from Police. Also, during this period provide to Owner legal copies of order on institution of criminal proceedings or order of refusal to institute a criminal case from relevant authorities after receiving it.
\n\n11.13. In case of losing vehicle under any circumstances, Renter shall:- Immediately make an application about situation to the nearest police station;- Immediately (not more than 24 hours) inform and follow instructions from Owner;- During 3 (three) days provide the vehicle registration certificate, OSAGO insurance policy and keys for the vehicle to Owner.
\n\n11.14. Renter agrees to provide personal information to Owner for processing, including all actions regulated by Federal law from 27.07.2006 No 152F3 “About personal information”.
\n\n11.15. Renter is responsible for safety of rented vehicle during all rental period till the moment of returning it to Owner. In case of loss or damage to vehicle, Renter shall indemnify all losses to Owner, including missed profit from idled vehicle.
\n\n11.16. In case of exceeding the speed limit stated in clause 4.2.5 of this Agreement (according to GPS/GLONASS data) Owner deducts the penalties from deposit.
\n\n11.17. In case of gross, constantly repeated exceeding of the speed limit stated in clause 4.2.5 of this Agreement (according to GPS/GLONASS data), Owner has right to recover the vehicle without returning deposit or any rental refund. If Owner couldn’t recover the vehicle, Renter shall pay the penalty, which is equal to deposit.
\n\n11.18. In case when vehicle placed on penalty parking of traffic police (GIBDD) by fault of Renter, Renter shall pay the parking bill and all corresponding penalties. In this case, according to clause 2.4, there is no rental recalculations.
\n\n12. Renter bears material responsibility if vehicle is stolen with keys and documents.
\n\n13. Renter accepts the risk of losing the value of commodity of rented vehicle, in case of guiltiness in car accident.
\n\n14. If Renter inflict harm to third party during the use of the vehicle, which made the insurance company to pay insurance benefit to sufferer (sufferers), Renter shall indemnify the Owner for losses related to regressive requirements of insurance company.
\n\n15. Owner is not responsible for Renter’s administrative offences. If Owner receives administrative penalty for offences that are done by Renter, Owner sends penalty to Renter, which shall pay the penalty during three days from the moment of receiving it. In such case penalty will be sent to Renter postal address, which is referred in agreement.
\n\n16. From the moment of receiving the vehicle till the moment of returning it to Owner, Renter is the owner of the rented vehicle and according to existing laws of the Russian Federation he is responsible for harm, done to life, health and property of third party in a result of using the vehicle at part, in which losses of civil responsibility will exceed the amount of insurance benefits.
\n\n17. Renter himself fully pays all losses related to harm to his life and health, and also life and health of passengers in rented vehicle, during rental period.
\n\n18. Renter himself fully responsible for any damage to luggage, belonging to Renter or passengers on any law basis, and which was in rented vehicle during rental period.

10.8. In case of breaching the clause 10.7 of this agreement, Vehicle will be washed by employees of car rental company with subsequent signing of delivery-acceptance act. According to price list of additional services the cost for this service will be subtracted from deposit.
10.9. Condition, vehicle configuration, accessories and other information about returned vehicle must be checked by Owner in presence of Renter and marked in delivery-acceptance act.
10.10. In case of failure occurrence due to Renter’s use of vehicle during this agreement, or failure detected during delivery-acceptance procedure at the end of the rental period, Renter shall fully indemnify the Owner for transportation, repairing (according to calculation) and losses for idle (repair) time of vehicle.
11. Renter agrees to:
11.1. Keep vehicle, in case of not using it, only on secured car parkings, which has all necessary documents to do such service, which can be approved by pay checks. In case of leaving the vehicle unattended, Renter takes responsibility for any loss or damage to the vehicle or Owner. This circumstance distributes on all cases of stolen vehicle.
11.2. Constantly keep vehicle documents with himself.
11.3. Be responsible for loss or damage that is done by rented vehicle, its parts or accessories to third party or Owner.
11.4. Regularly check vehicle for interior or exterior failures. If something detected, immediately inform Owner.
11.5. On first demand provide the vehicle to Owner for doing technical inspection.
11.6. Pay rental for vehicle in a timely manner.
11.7. To take good care of the rented property.
11.8. Immediately inform the Owner about all technical failures, detected during the use of the vehicle. If using the vehicle with detected failures is dangerous or impossible, immediately stop using the vehicle.
11.9. Renter shall do all sorts of assist to Owner in settlement of insurance dispute and in receiving insurance benefit.
11.10. On first demand, Renter shall, without any dispute, compensate to Owner losses, which are done by Renter.
11.11. In case of a car accident, Renter shall strictly fulfill all the requirements, that are stated for such cases in existing laws, including traffic laws and OSAGO laws. In addition to stated requirements, Renter shall:- Immediately (not more than 24 hours) inform Owner about accident and follow instructions from Owner;- If there is technical feasibility, make photo and video of car accident and provide it to Owner;- After all proceedings related to car accident, receive process documents (references, protocols, statements) composed by relevant authorities (police, prosecutor’s office, court, etc.), and be at mentioned authorities at specified time;- During 3 (three) days after receiving all documents from relevant authorities, provide them to Owner;- If in a result of car accident vehicle is no longer suitable for further use, Renter shall deliver wrecked vehicle on Renter’s expense to place of receipt, specified by Owner.
11.12. In case of detecting damages to vehicle, caused by natural disaster or third party criminal acts, including falling snow, ice from the roofs of the houses or other buildings, or falling of other objects, Renter shall:- Immediately make an application about situation to the nearest police station;- Immediately (not more than 24 hours) inform and follow instructions from Owner;- During 2 (two) days provide to Owner advice note of accepting the application from Police. Also, during this period provide to Owner legal copies of order on institution of criminal proceedings or order of refusal to institute a criminal case from relevant authorities after receiving it.
11.13. In case of losing vehicle under any circumstances, Renter shall:- Immediately make an application about situation to the nearest police station;- Immediately (not more than 24 hours) inform and follow instructions from Owner;- During 3 (three) days provide the vehicle registration certificate, OSAGO insurance policy and keys for the vehicle to Owner.
11.14. Renter agrees to provide personal information to Owner for processing, including all actions regulated by Federal law from 27.07.2006 No 152F3 “About personal information”.
11.15. Renter is responsible for safety of rented vehicle during all rental period till the moment of returning it to Owner. In case of loss or damage to vehicle, Renter shall indemnify all losses to Owner, including missed profit from idled vehicle.
11.16. In case of exceeding the speed limit stated in clause 4.2.5 of this Agreement (according to GPS/GLONASS data) Owner deducts the penalties from deposit.
11.17. In case of gross, constantly repeated exceeding of the speed limit stated in clause 4.2.5 of this Agreement (according to GPS/GLONASS data), Owner has right to recover the vehicle without returning deposit or any rental refund. If Owner couldn’t recover the vehicle, Renter shall pay the penalty, which is equal to deposit.
11.18. In case when vehicle placed on penalty parking of traffic police (GIBDD) by fault of Renter, Renter shall pay the parking bill and all corresponding penalties. In this case, according to clause 2.4, there is no rental recalculations.
12. Renter bears material responsibility if vehicle is stolen with keys and documents.
13. Renter accepts the risk of losing the value of commodity of rented vehicle, in case of guiltiness in car accident.
14. If Renter inflict harm to third party during the use of the vehicle, which made the insurance company to pay insurance benefit to sufferer (sufferers), Renter shall indemnify the Owner for losses related to regressive requirements of insurance company.
15. Owner is not responsible for Renter’s administrative offences. If Owner receives administrative penalty for offences that are done by Renter, Owner sends penalty to Renter, which shall pay the penalty during three days from the moment of receiving it. In such case penalty will be sent to Renter postal address, which is referred in agreement.
16. From the moment of receiving the vehicle till the moment of returning it to Owner, Renter is the owner of the rented vehicle and according to existing laws of the Russian Federation he is responsible for harm, done to life, health and property of third party in a result of using the vehicle at part, in which losses of civil responsibility will exceed the amount of insurance benefits.
17. Renter himself fully pays all losses related to harm to his life and health, and also life and health of passengers in rented vehicle, during rental period.
18. Renter himself fully responsible for any damage to luggage, belonging to Renter or passengers on any law basis, and which was in rented vehicle during rental period.

- Залоговый депозит для граждан РФ составляет от 5000 рублей в зависимости от класса автомобиля, для граждан других государств – от 10000 рублей. Если Вы соблюдаете условия аренды автомобиля, прописанные в договоре, залог возвращается.
- Если Вы вернете автомобиль раньше, мы пересчитаем стоимость аренды и вернем разницу.
- Если Вы задержите возврат автомобиля больше чем на час, нужно будет оплатить следующие сутки проката.
- 100% предоплата всей стоимости проката транспортного средства в момент передачи.
Дополнительные условия
- Все автомобили застрахованы по КАСКО, ОСАГО.
- Минимальная продолжительность аренды – 1 сутки (24 часа) с момента получения автомобиля.
- Мы выдадим и примем у Вас автомобиль в любое время и по любому адресу по предварительной договоренности. Стоимость доставки/возврата в черте города от 1000 руб.
- Когда мы отдаем Вам автомобиль он чистый и с полным баком. Просим вернуть его также чистым и заправленным. Если автомобиль возвращается грязным и/или не заправленным, Вам нужно будет оплатить компенсацию из расчета: от 1200 руб. за мойку в зависимости от автомобиля и степени загрязнения, и заправку из расчета 65 руб/литр топлива;
- На прокатном автомобиле запрещено выезжать за пределы Российской Федерации. Если Вам нужно выехать из города / области – предупредите нас об этом при оформлении договора.
- Если за руль арендованного ТС сядет дополнительный водитель, он должен быть записан в договор. Требования по возрасту, стажу, необходимым документам сохраняются.
- Ограничение пробега для автомобиля - 400 км в сутки.
Считаем суммарно за весь период аренды. При превышении лимита – оплата от 7 рублей за каждый километр свыше. - Арендодатель может отказать в выдаче автомобиля без объяснения причины, о чем уведомляет клиента не менее чем за 2 часа до предполагаемой выдачи.

1. Использование автомобиля не должно противоречить его назначению, техническим характеристикам, правилам страхования автомобиля и положениям настоящего Договора.
2. Передаваемое в аренду Транспортное средство принадлежит Арендодателю на законном основании.
3. Арендатор вправе вернуть автомобиль раньше срока, предусмотренного настоящим Договором, при этом происходит перерасчет арендных платежей кратного 1 суткам. Арендодатель возвращает Арендатору соответствующую часть полученной арендной платы, исчисляя ее со дня следующего за днем фактического возврата автомобиля.
4. В случае несвоевременной передачи транспортного средства по истечении срока аренды, в случае причинения Арендодателю убытков, признания страховой компанией случая, участником которого стал Арендатор, не страховым, а так же в случае нарушения Арендатором своих обязательств по настоящему Договору, Арендодатель имеет право возместить убытки за счет суммы залога, в безусловном порядке. Оставшуюся сумму залога Арендодатель возвращает Арендатору.
5. В случае недостаточности суммы залога для погашения убытков, Арендодатель вправе взыскать недостающую сумму с Арендатора в порядке, предусмотренном действующим законодательством.
6. В случае нарушения Арендатором любого из положений договора Арендодатель вправе в одностороннем порядке без какого-либо предварительного уведомления расторгнуть настоящий договор с возможным последующим изъятием автомобиля независимо от его местонахождения. В этом случае Арендодатель не несет ответственность за пропажу или ущерб, причиненный вещам или материалам, находившимся в автомобиле в момент изъятия. Остаток арендной платы и суммы залога в этом случае возврату не подлежат.
7. Стороны договора согласны с тем, что в соответствии с действующим законодательством к договору аренды транспортного средства без водителя, не применяются положения и правила о возобновлении договора аренды на неопределенный срок и о преимущественном праве Арендатора на заключение договора аренды на новый срок.
8. Истечение срока действия настоящего Договора влечет за собой прекращение обязательств сторон по нему, но не освобождает от ответственности за его нарушения, если таковые имели место при исполнении условий договора в течение срока аренды.
9. Права и обязанности Арендодателя
9.1. Арендодатель предоставляет автомобиль в исправном состоянии, в чистом виде, с полным баком бензина. Передача осуществляется по акту приёма-передачи, который составлен Арендодателем и подписывается Сторонами (Приложение № 2 к настоящему договору).
9.2. Арендодатель, как собственник автомобиля, несет расходы по страхованию автомобиля, в порядке, установленном действующим законодательством (ОСАГО).
9.3. Арендодатель вправе требовать от Арендатора уплаты арендных платежей в установленный срок.
9.4. Арендодатель вправе потребовать расторжения настоящего договора, в случае, если Арендатор пользуется имуществом ненадлежащим образом (не в соответствии с назначением транспортного средства и с нарушением условий настоящего договора).
9.5. Арендодатель вправе отказаться от приемки транспортного средства по окончании срока действия настоящего договора в случае не исполнения Арендатором п.п. 11.1, 11.2, 11.3, 11.9, 11.10, 11.11, 11.12 настоящего договора, если техническое состояние транспортного средства не пригодно для дальнейшей эксплуатации. Арендатор в данном случае обязан возместить причиненные Арендодателю убытки путем компенсации стоимости транспортного средства или передачи аналогичного транспортного средства в собственность Арендодателя.
9.6. В случае просрочки возврата транспортного средства после окончания срока действия аренды более 2 часов Арендодатель вправе обратиться в правоохранительные органы с заявлением о возбуждении уголовного дела по факту хищения или угона 9.7.Арендодатель имеет право зачесть в счет причитающихся ему платежей и штрафов по настоящему Договору сумму залога в безусловном порядке.
9.7. При не соблюдении Арендатором п. 10.8. настоящего договора Арендодатель оставляет за собой право не принимать автомобиль и не возвращать залог до устранения недостатков.
9.8. В случае грубого нарушения условий настоящего Договора, Арендодатель имеет право расторгнуть договор в одностороннем порядке, без какого-либо предварительно уведомления Арендатора, с немедленным изъятием автомобиля из пользования Арендатора, при этом перерасчет арендных платежей не производится, вне зависимости от срока использования автомобилем.
9.10. Арендодатель предоставляет автомобиль Арендатору, с правом наблюдения за его передвижением через спутниковую систему GPS/ГЛОНАСС.
10. Права и обязанности Арендатора
10.1. Арендатор своими силами осуществляет управление арендованным Автомобилем и самостоятельно производит его эксплуатацию.
10.2. Арендатор не вправе производить разборку и ремонт автомобиля, а так же не вправе производить вмешательство в конструкцию автомобиля и устанавливать на него дополнительное оборудование без предварительно письменного согласия Арендодателя.
10.3. Арендатор не имеет право переуступать свои права и обязанности по настоящему договору третьим лицам, а также не вправе сдавать имущество в субаренду, заключать с третьими лицами договоры перевозки, в ходе которых используется автомобиль, закладывать имущество, сдавать его в поднаем, иначе предоставлять права распоряжения имуществом третьим лицам. Кроме того, Арендатор обязуется не использовать автомобиль для буксировки любых транспортных средств, для езды с прицепом или по бездорожью, для участия в спортивных соревнованиях (ралли, гонки и т.п.) а также обучению вождения.
10.4. Арендатор обязан соблюдать скоростной режим установленный Правилами дорожного движения при передвижении в городской черте и за пределами городской черты.
10.5. Арендатор несет все расходы, связанные с эксплуатацией автомобиля, не отнесенные к обязанностям арендодателя (в том числе по бензину).
10.6. Арендатор обязуется по истечении срока действия Договора возвратить Арендодателю предоставленный автомобиль в полной комплектации, в надлежащем техническом состоянии, с учетом нормального износа (в состоянии пригодном для эксплуатации без ухудшения его потребительских качеств и внешнего вида), с полным баком бензина согласно Приложению № 1.
10.7. Автомобиль должен быть возвращен в чистом виде, то есть после полной мойки автомобиля (кузов, салон). Арендатор имеет право мыть автомобиль только на специализированных предприятиях.
10.8. В случае не выполнения п. 10.7. настоящего договора, мойка автомобиля осуществляется силами сотрудников автопроката с последующим подписанием акта приёма-передачи. Стоимость данной услуги вычитается из суммы залога арендатора в безусловном порядке согласно прейскуранта о дополнительных услугах.
10.9. Исправность, комплектация, принадлежности и другие данные сдаваемого в аренду автомобиля должны быть проверены Арендодателем в присутствии Арендатора и отмечены в акте приёма-передачи.
10.10. В случае возникновения неисправностей транспортного средства вследствие нарушения Арендатором правил технической эксплуатации как во время аренды, так и обнаруженных в ходе сдачи-приемки транспортного средства после окончания срока аренды, Арендатор обязан возместить Арендодателю стоимость транспортировки, ремонта (согласно калькуляции), а также убытки, вызванные простоем транспортного средства, связанным с ремонтом.
11. Арендатор обязуется:
11.1. Рекомендуем хранить транспортное средство в случае его не использования на охраняемых автостоянках. В случае оставления транспортного средства без присмотра Арендатор несет ответственность за вред, причиненный транспортному средству. Данное обстоятельство распространяется на случаи хищения и угона.
11.2. Постоянно хранить при себе документы на автомобиль.
11.3. Нести ответственность за вред (ущерб), причиненный арендованным транспортным средством, его механизмами, устройствами и оборудованием третьим лицам или Арендодателю.
11.4. Производить регулярную тщательную проверку автомобиля на наличие внешних и внутренних неисправностей, а при их обнаружении незамедлительно ставить в известность Арендодателя.
11.5. По первому требованию Арендодателя предоставить автомобиль для прохождения технического осмотра.
11.6. Своевременно производить оплату аренды автомобиля.
11.7. Бережно относиться к вверенному ему имуществу.
11.8. Незамедлительно сообщать Арендодателю обо всех технических неисправностях, обнаруженных во время использования автомобиля. При этом в случае обнаружения неисправностей, делающих невозможным либо опасным управление автомобилем, немедленно прекратить его эксплуатацию.
11.9. Арендатор обязуется оказать всевозможное содействие Арендодателю в урегулирование страхового спора, а так же в получении страхового возмещения при возникновении страхового случая.
11.10. В бесспорном порядке компенсировать Арендодателю ущерб, нанесенный Арендатором, по первому требованию Арендодателя.
11.11. При возникновении ДТП Арендатор обязан неукоснительно выполнять все требования, предусмотренные для подобных случаев действующим законодательством, в том числе Правилами дорожного движения РФ, а также законодательством об ОСАГО. Помимо установленных требований Арендатор обязан:
- Незамедлительно (не позднее 24 часов) известить Арендодателя о ДТП и действовать в соответствии с его указаниями;
- При наличии технической возможности произвести фото-видеосъемку места ДТП и передать запись Арендодателю;
- По факту разбирательства по обстоятельствам ДТП получить от компетентных органов (полиция, прокуратура, суд и т.д.) составленные ими процессуальные документы по факту ДТП (справки, протоколы, постановления и.т.д.), а также являться по вызову в указанные органы в назначенное время;
- В течение 3 (трёх) дней после получения всех документов от компетентных органов, предоставить их Арендодателю;
- Если в результате ДТП транспортное средство получило повреждения, исключающие его дальнейшую эксплуатацию, Арендатор обязуется доставить аварийное транспортное средство за свой счет в место, указанное Арендодателем.
11.12. В случае обнаружения повреждений транспортного средства, вызванных стихийным бедствием или противоправными действиями третьих лиц, в том числе падение снега, льда с крыш жилых домов зданий, сооружений, падение иных предметов, Арендатор обязуется:
- Немедленно обратиться в ближайшее отделение полиции с заявлением о происшествии;
- Незамедлительно (не позднее 24 часов) проинформировать Арендодателя и действовать в соответствии с его указаниями;
- В течение 2 (двух) дней предоставить Арендодателю талон-уведомление о принятии заявления органами МВД, а также в этот же срок предоставить Арендодателю заверенные копии постановления о возбуждении уголовного дела либо об отказе в возбуждении уголовного дела из компетентных органов после их получения.
11.13. В случае утраты транспортного средства при любых обстоятельствах Арендатор обязуется:
- Немедленно обратиться в ближайший отдел полиции с заявлением о происшествии;
- Незамедлительно (не позднее 24 часов) проинформировать Арендодателя и действовать в соответствии с его указаниями;
- В течение 3 (трех) дней передать Арендодателю свидетельство о регистрации транспортного средства, страховой полис ОСАГО и ключи от транспортного средства.
11.14. Арендатор даёт свое согласие на предоставление и обработку персональных данных Арендодателю, включая любые действия, предусмотренные Федеральным законом от 27.07.2006 года № 152-ФЗ « О персональных данных.
11.15. Арендатор несет ответственность за сохранность арендуемого автомобиля в течение всего срока аренды до момента передачи его Арендодателю. В случае утраты или повреждения автомобиля Арендатор обязан возместить Арендодателю все причиненные убытки, в том числе упущенную выгоду, вызванную простоем автомобиля.
11.16. В случае нарушения скоростного режима установленного п. 4.2.5. настоящего Договора (согласно данным GPS/ГЛОНАСС навигации) Арендодателем из залога удерживаются штрафы.
11.17. При грубом и неоднократном нарушении Арендатором скоростного режима (согласно данным GPS/ГЛОНАСС навигации) установленного п. 4.2.5. настоящего Договора, Арендодатель имеет право изъять транспортное средство без возврата Арендатору ранее уплаченных денежных средств за арендуемое транспортное средство и залога. В случае если Арендодателем не было изъято транспортное средство, то Арендатор уплачивает штраф в размере стоимости залога.
11.18. В случае помещения транспортного средства на штрафную стоянку ГИБДД по вине Арендатора, на последнего возлагается обязанность по оплате соответствующей стоянки, с оплатой и необходимых штрафных санкций. В данном случае арендная плата за пользование автомобилем перерасчету, в соответствии с п. 2.4. настоящего договора, не производится.
12. Арендатор несет полную материальную ответственность если автомобиль угнан с ключами и документами.
13. Арендатор несет риск утраты товарной стоимости арендованного автомобиля, в случае его виновности в Дорожно-транспортном происшествии.
14. В случае причинения Арендатором вреда третьим лицам при использовании автомобиля, что повлекло обязанность страховой компании выплатить страховое возмещение потерпевшему (потерпевшим), Арендатор обязан возместить Арендодателю расходы, связанные с регрессными требованиями страховой компании.
15. Арендодатель не несет ответственности за совершенные Арендатором административные правонарушения. В случае, если Арендодателю направляется требование об уплате штрафов за совершенные Арендатором правонарушения, Арендодатель пересылает данное требование Арендатору, который обязан в течение трех дней с момента получения соответствующего требования его удовлетворить. При этом требование об уплате штрафа направляется по почтовому адресу Арендатора, указанному им при подписании настоящего Договора.
16. С момента получения автомобиля в пользование и до сдачи его Арендодателю, Арендатор является владельцем арендованного транспортного средства и в соответствии с действующим законодательством Российской Федерации несет ответственность за вред, причиненный жизни, здоровью и имуществу третьих лиц в результате эксплуатации автомобиля в той части, в какой расходы по гражданской ответственности превысят суммы страховых выплат.
17. Арендатор самостоятельно и за свой счет в полном объеме несет расходы, связанные с вредом, причиненным его жизни и здоровью, а также жизни и здоровью пассажиров, находившихся в автомобиле в период его эксплуатации Арендатором.
18. Арендатор самостоятельно и за свой счет в полном объеме несет ответственность за ущерб, причиненный багажу, принадлежащему ему или пассажирам на любом законном основании, и находившемуся в автомобиле в период его эксплуатации Арендатором

\n\n1. Use of the vehicle must not contradict its purpose, technical characteristics, terms of insurance and terms of this Agreement.
\n\n2. Rented car is a legal propriety of Owner.
\n\n3. Renter can return vehicle ahead of schedule, termed by this Agreement. In this case owner recalculates rental payment divisible 1 day. Owner refund Renter the corresponding part of rental payment, calculated from day after the day of returning the car. (will be refunded for unused days, day of returning - is using day).
\n\n4. In the case of a delayed transfer of the vehicle upon the expiration of the rent term, in the case of losses to the Owner, in the case of the non-insurance accident occurred in rent period, and in case the Renter breaches hiss obligations under this Agreement, the Owner has the right to compensate for the losses the amount of bail unconditionally. The remaining amount of the deposit the Owner returns to the Renter.
\n\n5. If the deposit was not enough to compensate losses, Owner has right to make Renter compensate losses in a manner provided by the law.
\n\n6. If Renter breaches any term of this agreement, Owner has right to unilaterally terminate the agreement without previous notice with possible subsequent recovering of the rented vehicle, regardless of its location. In case of vehicle recovering, Owner is not responsible for loss or damage to things left in vehicle. Renter will not get deposit back or refund for unused days.
\n\n7. Both parties agree that according to existing laws of vehicle without driver rental agreement, there are no terms and rules about renewing agreement for unlimited period and there are no exclusive right of Renter in case of making a new agreement for a new period.
\n\n8. Ending of rental period of this agreement ends parties obligations, but don’t relieve from the responsibility of violations, if there were any during rental period.
\n\n9. Rights and obligations of Owner
\n\n9.1. Owner provides vehicle in good working order and condition, safe and clean condition, with full fuel tank. The picking up of the vehicle procedure is done by delivery-acceptance act (acceptance report), which is drafted by Owner and signed by Parties (Appendix No.2 to this agreement).
\n\n9.2. Owner, as vehicle owner, pays for vehicle insurance in a manner provided by existing laws (OSAGO).
\n\n9.3. Owner has right to require from Renter rental payment within the prescribed time.
\n\n9.4. Owner has right to request agreement termination in case if Renter uses vehicle not in a right way (not in its purpose and with breaching of the terms of these agreement).
\n\n9.5. Owner has right to refuse acceptance of the vehicle after expiration of rental agreement in case if Renter breached clause 11.1, 11.2, 11.3, 11.9, 11.10, 11.11, 11.12 of this agreement, if technical condition of vehicle is no longer suitable for further use. Renter shall fully indemnify the Owner by compensating full cost of vehicle or transfer the ownership of analogous vehicle to Owner.
\n\n9.6. If Renter do not return vehicle more than 2 hours after expiration of rental agreement, Owner has right to request law enforcement authorities to have opened criminal proceedings against Renter on suspicion of stolen vehicle.
\n\n9.7. If Renter breaches clause 10.9 of this agreement, Owner has right to not accept the vehicle and not refund the deposit until all defects are corrected.
\n\n9.8. In case of breaching the terms of this Agreement, Owner has right to unilaterally terminate it without previous notice for Renter, with immediate recovery of rental vehicle. There are no recalculations of rental payments, regardless of period of actual usage of the rented vehicle.
\n\n9.10. Owner provides vehicle to Renter with right to monitor its movement through satellite system GPS/GLONASS.
\n\n10. Rights and obligations of Renter
\n\n10.1. Renter operates and drives the Vehicle by himself.
\n\n10.2. Renter has no right to salvage and repair the vehicle, do modifications to it and install accessories on it without previous written agreement from Owner.
\n\n10.3. Renter has no right to assign rights and obligations under this Agreement to any third party, to sublet or hire the vehicle to any third party, to pledge the vehicle, to sublet the vehicle to any third party in any other ways. Moreover, Renter shall not use the vehicle to push or tow another vehicle, to drive it with trailer or offroad, use the vehicle in any race, competition (rally, race and so on) or driving practice.
\n\n10.4. Renter must follow the speed limits stated by traffic laws inside and outside of the city.
\n\n10.5. Renter pays all use of the vehicle expenses, which are not in Owner’s obligations (including fuel).
\n\n10.6. Renter shall return the vehicle in complete set, in a proper technical condition, with allowance for normal wear (in a good using condition with no degradation of its consumer appeal and exterior), with full fuel tank according to Appendix No.1.
\n\n10.7. Vehicle must be returned clean. It means full service wash (exterior and interior). Renter shall wash vehicle only on specialized car washes.
\n\n10.8. In case of breaching the clause 10.7 of this agreement, Vehicle will be washed by employees of car rental company with subsequent signing of delivery-acceptance act. According to price list of additional services the cost for this service will be subtracted from deposit.
\n\n10.9. Condition, vehicle configuration, accessories and other information about returned vehicle must be checked by Owner in presence of Renter and marked in delivery-acceptance act.
\n\n10.10. In case of failure occurrence due to Renter’s use of vehicle during this agreement, or failure detected during delivery-acceptance procedure at the end of the rental period, Renter shall fully indemnify the Owner for transportation, repairing (according to calculation) and losses for idle (repair) time of vehicle.
\n\n11. Renter agrees to:
\n\n11.1. Keep vehicle, in case of not using it, only on secured car parkings, which has all necessary documents to do such service, which can be approved by pay checks. In case of leaving the vehicle unattended, Renter takes responsibility for any loss or damage to the vehicle or Owner. This circumstance distributes on all cases of stolen vehicle.
\n\n11.2. Constantly keep vehicle documents with himself.
\n\n11.3. Be responsible for loss or damage that is done by rented vehicle, its parts or accessories to third party or Owner.
\n\n11.4. Regularly check vehicle for interior or exterior failures. If something detected, immediately inform Owner.
\n\n11.5. On first demand provide the vehicle to Owner for doing technical inspection.
\n\n11.6. Pay rental for vehicle in a timely manner.
\n\n11.7. To take good care of the rented property.
\n\n11.8. Immediately inform the Owner about all technical failures, detected during the use of the vehicle. If using the vehicle with detected failures is dangerous or impossible, immediately stop using the vehicle.
\n\n11.9. Renter shall do all sorts of assist to Owner in settlement of insurance dispute and in receiving insurance benefit.
\n\n11.10. On first demand, Renter shall, without any dispute, compensate to Owner losses, which are done by Renter.
\n\n11.11. In case of a car accident, Renter shall strictly fulfill all the requirements, that are stated for such cases in existing laws, including traffic laws and OSAGO laws. In addition to stated requirements, Renter shall:- Immediately (not more than 24 hours) inform Owner about accident and follow instructions from Owner;- If there is technical feasibility, make photo and video of car accident and provide it to Owner;- After all proceedings related to car accident, receive process documents (references, protocols, statements) composed by relevant authorities (police, prosecutor’s office, court, etc.), and be at mentioned authorities at specified time;- During 3 (three) days after receiving all documents from relevant authorities, provide them to Owner;- If in a result of car accident vehicle is no longer suitable for further use, Renter shall deliver wrecked vehicle on Renter’s expense to place of receipt, specified by Owner.
\n\n11.12. In case of detecting damages to vehicle, caused by natural disaster or third party criminal acts, including falling snow, ice from the roofs of the houses or other buildings, or falling of other objects, Renter shall:- Immediately make an application about situation to the nearest police station;- Immediately (not more than 24 hours) inform and follow instructions from Owner;- During 2 (two) days provide to Owner advice note of accepting the application from Police. Also, during this period provide to Owner legal copies of order on institution of criminal proceedings or order of refusal to institute a criminal case from relevant authorities after receiving it.
\n\n11.13. In case of losing vehicle under any circumstances, Renter shall:- Immediately make an application about situation to the nearest police station;- Immediately (not more than 24 hours) inform and follow instructions from Owner;- During 3 (three) days provide the vehicle registration certificate, OSAGO insurance policy and keys for the vehicle to Owner.
\n\n11.14. Renter agrees to provide personal information to Owner for processing, including all actions regulated by Federal law from 27.07.2006 No 152F3 “About personal information”.
\n\n11.15. Renter is responsible for safety of rented vehicle during all rental period till the moment of returning it to Owner. In case of loss or damage to vehicle, Renter shall indemnify all losses to Owner, including missed profit from idled vehicle.
\n\n11.16. In case of exceeding the speed limit stated in clause 4.2.5 of this Agreement (according to GPS/GLONASS data) Owner deducts the penalties from deposit.
\n\n11.17. In case of gross, constantly repeated exceeding of the speed limit stated in clause 4.2.5 of this Agreement (according to GPS/GLONASS data), Owner has right to recover the vehicle without returning deposit or any rental refund. If Owner couldn’t recover the vehicle, Renter shall pay the penalty, which is equal to deposit.
\n\n11.18. In case when vehicle placed on penalty parking of traffic police (GIBDD) by fault of Renter, Renter shall pay the parking bill and all corresponding penalties. In this case, according to clause 2.4, there is no rental recalculations.
\n\n12. Renter bears material responsibility if vehicle is stolen with keys and documents.
\n\n13. Renter accepts the risk of losing the value of commodity of rented vehicle, in case of guiltiness in car accident.
\n\n14. If Renter inflict harm to third party during the use of the vehicle, which made the insurance company to pay insurance benefit to sufferer (sufferers), Renter shall indemnify the Owner for losses related to regressive requirements of insurance company.
\n\n15. Owner is not responsible for Renter’s administrative offences. If Owner receives administrative penalty for offences that are done by Renter, Owner sends penalty to Renter, which shall pay the penalty during three days from the moment of receiving it. In such case penalty will be sent to Renter postal address, which is referred in agreement.
\n\n16. From the moment of receiving the vehicle till the moment of returning it to Owner, Renter is the owner of the rented vehicle and according to existing laws of the Russian Federation he is responsible for harm, done to life, health and property of third party in a result of using the vehicle at part, in which losses of civil responsibility will exceed the amount of insurance benefits.
\n\n17. Renter himself fully pays all losses related to harm to his life and health, and also life and health of passengers in rented vehicle, during rental period.
\n\n18. Renter himself fully responsible for any damage to luggage, belonging to Renter or passengers on any law basis, and which was in rented vehicle during rental period.
